Terms & Conditions

1. Use of the Site

1.1. This website (the "Site") is operated by Collinson Latitude on behalf of Virgin Atlantic Airways Limited ("VAA"/"we"/"us"). By accessing or using the Site you agree to be bound by these terms and conditions as amended or updated by us from time to time.

1.2. These terms and conditions apply in addition to the Flying Club terms and conditions which are available here (together the "Terms of Use"). In the event of any conflict, the Flying Club terms and conditions shall prevail.

1.3. These Terms of Use contain important legal obligations and you are advised to read them carefully before using the Site.

1.4. You must be over eighteen (18) years of age to use this Site. You are only permitted to use this Site for your own private and non-commercial use.

1.5. You must only use this Site in accordance with and subject to the Terms of Use and only for lawful and proper purposes. In particular you must not:

  • Post, transmit or disseminate any information on or via this Site which is or may be considered by us to be harmful, obscene, defamatory and/or illegal;
  • In any way interfere attempt to interfere with the operation or functionality of the Site or obtain or attempt to obtain any unauthorised access to the Site;
  • Use the Site in any way which causes or may cause the rights of any other to be infringed;
  • Make any unauthorised, false and/or fraudulent purchase through the Site;
  • Do anything that imposes or might impose an unreasonable or disproportionately high load on the Site.

2. Flying Club miles

2.1. When you purchase goods and/or services through a third party retailer advertised on this Site you will be entitled to earn Flying Club miles, as long as you have logged into your Flying Club account on virginatlantic.com/flyingclub.

Online Shopping

2.2. When you purchase goods and/or services through a third party retailer advertised on this Site you will be entitled to earn Flying Club miles, as long as you have logged into your Flying Club account on www.virginatlantic.com/flyingclub.

2.3. Flying Club miles are only awarded on purchases made online with third party retailers featured on the Flying Club Online Shopping site accessed through the Shops Away Mile Finder or the 'SHOP NOW' button, shown when you are logged into your account..on the Shops Away partner page on virginatlantic.com

2.4. Flying Club miles will not be awarded on the purchase of gift vouchers or on taxes and/or delivery charges.

High Street Offers

2.5. Flying Club Miles will only be awarded on purchases made with retailers featured on the High Street Offers shopping pages of the Site after you have registered valid payment card(s) and made qualifying purchases with the registered payment card(s) at the participating merchant (in line with the specific offer Terms & Conditions which will be displayed on the High Street Offers shopping page.

2.6. It takes up to 24 hours for each payment card to be fully registered for Flying Club Miles awarding with 
qualifying High Street Offers retailers.

2.7. No Flying Club Miles will be awarded for purchases made using payment card(s) that were first registered 
on the Website less than 24 hours prior to the time of the purchase.

2.8. We reserve the right to change or withdraw retailers and offers featured on the High Street Offers pages at 
any time.

2.9. If you register payment card(s) that have previously been registered on the Site with another Website for a 
similar purpose, this may exclude the same card collecting Flying Club Miles.

2.10. If we believe that any form of Misconduct has occurred we may not award or may remove any Flying Club miles from your account.

General

2.11. We reserve the right to cancel any Flying Club miles awarded to you in respect of a purchase which you subsequently cancel (i.e. if you didn't pay for or later returned the goods and/or services for which the miles were awarded).

2.12. Any claim for missing Flying Club miles must be made to us in writing within 90 days of your purchase. All claims are resolved by us at our sole discretion.

2.13. No tier points will be earned for any purchases made via Online Shopping.

2.14. Flying Club kids accounts and 004 Flying Co accounts may not earn miles.

2.15. UK Flying Club members earn miles on every GBP pound spent and US Flying Club members earn miles on every USD spent. Purchases need to be made in local currencies of the retailer or member location?.

2.15. In order to earn miles the shopping transaction needs to be in the name of the Flying Club member.

3. This Site

3.1. We make no warranties or representations in respect of the content of the Site (including in relation to its availability and/or any virus or other harmful component) other than as required by law.

3.2. All information contained in and/or on the Site is made available to you for guidance only and your use of such information shall be entirely at your own risk.

3.3. We expressly exclude, to the fullest extent permitted by law, any liability for loss or damage, howsoever arising, suffered by you as a result of your use of the Site.

4. Third party websites

4.1. The Site contains references and/or links to the websites of third party retailers and/or advertisers. We have no control over and are not responsible for the content of any third party websites, nor for the goods, services and/or information supplied through them, or for any charges you incur as a result of your dealings with any third party.

4.2. Any dealings you enter into with a third party will be solely between you and that third party and in accordance with and subject to the terms and conditions and/or privacy policy of that third party. You should read and evaluate the content of these policies carefully.

4.3. In no event whatsoever shall VAA be liable, either directly or indirectly, for any loss or damage howsoever arising for personal injury, death, property, nor for pecuniary loss or damage arising out of your use of such goods, services or information offered by a third party.

5. Your information

5.1. We may from time to time collect information from you relating to your use of the Site. We use this information to provide and personalise the Site and other services you have requested.

5.2. We sometimes obtain additional information about you from other sources, including your demographic and lifestyle information from third parties.

5.3. You consent to us disclosing to third parties information that you have provided (or that we have obtained from you) about your account and/or shopping behaviour.

5.4. So that we may award you Flying Club miles, you also give us permission track your purchases through the creation and use of cookies.

5.5. We may also process your information to the extent permitted by law.

6. Miscellaneous

6.1. The Terms of Use contain the entire agreement between you and us relating to your use of the Site and no other statement (whether written or oral) will be incorporated.

6.2. We reserve our right to update, amend or otherwise modify the Terms of Use at any time without notice to you and you will be deemed to have accepted and be bound by any such change by your continued use of the Site.

6.3. We reserve our right to withdraw, cancel or vary at any time without notice to you any service or benefit provided or offered to you as a Flying Club member and in no event will we be liable for any loss or damage, howsoever arising, suffered by you as a result of our withdrawal, cancellation of variation.

6.4. Under no circumstances may you provide a link to this Site from an external website unless you have our prior written consent to do so.

6.5. You agree to indemnify, defend and hold us harmless against any claim made by a third party in connection with or arising out of your use of the Site or your violating of the Terms of Use.

6.6. Any provision declared unlawful or unenforceable by a court with competent authority shall be struck out and shall not affect the remaining provisions of the Terms of Use which shall continue unaffected.

6.7. All intellectual property rights associated with the Site (including but not limited to the text, graphics, design, layout and overall 'look and feel' of the Site and any underlying software code) shall remain the property of VAA and/or our respective licensors. You may only download, print or copy the content of the Site solely for your private and non-commercial use. Any other use of the content of this Site is strictly prohibited. Nothing in these Terms of Use shall be deemed to give you a licence or any other right to use the intellectual property rights owned and/or licensed by us.

6.8. No omission or delay by us in exercising any of our rights under these Terms of Use shall be treated as a waiver of that right and a waiver by us on one occasion shall not be deemed as constituting a waiver on any subsequent occasion.

6.9. No one other than you or us shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term contained in the Terms of Use.

6.10. Your use of the Site is governed by and interpreted in accordance with the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.

6.11. Any failure by you to comply with these Terms of Use may result in the termination of your use of the Site, the cancellation of your Flying Club membership and/or the forfeiture of any accrued Flying Club miles without further reference to you.

6.13. Virgin Atlantic retains sole discretion to close any Flying Club account as per the Flying Club Terms and Conditions if we suspect dishonest or suspicious behaviour.

6.14. If coupon/voucher codes that are not listed on our Shops Away website are used, the transaction will be invalidated from earning miles.

Virgin Atlantic Credit Card Account

Promotional rates will no longer apply from the beginning of any statement period during which you have breached your terms and conditions, for example if you haven't paid on time or have gone over your credit limit. You cannot transfer balances between MBNA accounts.
